Membership Agreement

1. Parties

a) Black Group Tekstil Ticaret Limited Şirketi, located in Beşiktaş/Istanbul, which operates the website www.blackfashion.com.tr (hereinafter referred to as Black Fashion).

b) Internet users who are members of the www.blackfashion.com.tr website.

2. Subject of the Agreement

This agreement defines the terms and conditions under which a member may use Black Fashion's website, www.blackfashion.com.tr. To establish this membership, simply enter the required member information and the password you choose, and complete your membership by giving the specified approvals and/or permissions. We especially request that you enter your name, email address/mobile phone number, and other mandatory information correctly, completely, and without errors; please correct any errors you notice. After completing the membership process, you can correct any deficiencies/errors you notice in the "My Account" section accessible from the member login page, or you can contact our customer service at +90 850 888 88 23.

3. Rights and Obligations of the Parties

3.1 The Member declares and undertakes that the personal and other information provided while registering on the Black Fashion website is accurate under the law, and that they will fully and immediately compensate www.blackfashion.com.tr for all damages it may suffer due to the inaccuracy of this information.

3.2 The member may not give the password provided to them by Black Fashion to any other person or organization; the right to use the password belongs solely to the member. Therefore, the member assumes all responsibility for any claims and demands that may be made against www.blackfashion.com.tr by third parties or authorized authorities due to such unauthorized use, and www.blackfashion.com.tr reserves the right to claim compensation and other demands arising from such unauthorized use.

3.3 The member hereby agrees and undertakes to comply with and not violate the provisions of legal legislation while using the Black Fashion website. Otherwise, all legal and criminal liabilities arising therefrom shall be solely and exclusively binding on the member.

3.4 Members may not use the Black Fashion website in any way that disrupts public order, violates general morality, disturbs or harasses others, for an illegal purpose, or infringes on the intellectual and copyright rights of others. Furthermore, members may not engage in activities or actions that prevent or hinder others from using the services (spam, viruses, Trojan horses, etc.).

3.5 The opinions and thoughts expressed, written, and used by members on the Black Fashion website are entirely the personal views of the members and are binding only on the person expressing them. These opinions and thoughts have no connection or affiliation with www.blackfashion.com.tr. Black Fashion is not responsible for any damages that third parties may suffer due to the opinions and thoughts expressed by a member, or for any damages that a member may suffer due to the opinions and thoughts expressed by third parties.

3.6 Black Fashion will not be held responsible for the unauthorized reading of member data or for any damage that may occur to member software and data. The member hereby agrees not to claim compensation from Black Fashion for any damage that may be incurred as a result of using the Black Fashion website.

3.7 The member agrees not to access or use the software and data of other internet users without authorization. Otherwise, the member shall be solely responsible for all legal and criminal liabilities arising therefrom.

3.8 Any member who violates one or more of the clauses in this membership agreement shall be personally liable, both criminally and legally, for such violation, and www.blackfashion.com.tr shall be held harmless from the legal and criminal consequences of such violations. Furthermore, in the event that the matter is brought to court due to this violation, Black Fashion reserves the right to claim compensation from the member for non-compliance with the membership agreement.

3.9 Black Fashion reserves the right to unilaterally terminate a member's membership and delete customer files, documents, and information at any time. The member accepts this provision in advance. In this case, Black Fashion bears no responsibility whatsoever.

3.10 The software and design of the Black Fashion website are the property of Black Fashion, and the copyright and/or other intellectual property rights related thereto are protected by relevant laws. Members may not use, acquire, or modify these without permission. Other companies and their products mentioned on this website are trademarks of their respective owners and are also protected under intellectual property rights.

3.11 Black Fashion may collect certain information for the purpose of improving and developing the www.blackfashion.com.tr website and/or within the framework of legal regulations, such as the name of the internet service provider used to access the site and the internet protocol (IP) address, the date and time of access to the site, the pages accessed while on the site, and the internet address of the website that provides direct access to the site.

3.12 Black Fashion may disclose a member's personal information when legally required to do so, or when it believes in good faith that it is necessary to comply with legal requirements or legal processes served on www.blackfashion.com.tr; and to protect and defend the rights and property of the Black Fashion website family.

3.13 Black Fashion website has taken measures within its available means to ensure it is free from viruses and similar malicious software. However, for ultimate security, the user must provide their own virus protection system and ensure the necessary protection. In this context, by accessing the Black Fashion website, the member is deemed to have accepted responsibility for all errors that may occur in their software and operating systems and for all direct or indirect consequences thereof.

3.14 Black Fashion reserves the right to change the content of the Black Fashion website at any time, to modify or terminate any service provided to users, or to delete user information and data registered on the Black Fashion website.

3.15 Black Fashion may change, update, or cancel the terms of this membership agreement at any time without prior notice or warning. Any changed, updated, or repealed provision will be effective for all members from the date of publication.

3.16 The parties acknowledge and agree that all computer records belonging to Black Fashion shall be considered as the sole and exclusive evidence and that said records constitute an evidentiary agreement.

3.17 Black Fashion, in accordance with this membership agreement, has the right to send informational emails to the email addresses registered with it and informational SMS messages to the mobile phones of its members. By approving this membership agreement, the member is deemed to have accepted the sending of informational emails to their email address and informational SMS messages to their mobile phone.

3.18All credit card transactions and approvals during your use of our site are carried out online between you and the relevant banks and similar card organizations, independently of our company. Members are solely responsible for any problems that may occur during payment, such as phishing attacks. Our company will not view any data screens, including the member's bank information and password, and will connect you to secure payment platforms provided by banks.

3.19 The security and terms of use published on our website apply; our company is not responsible for any disputes, material or moral damages and losses that may arise from the use of information from websites accessed for advertising, banners, content viewing or any other purpose, from any notifications received, and from mobile applications, as well as from the ethical principles, privacy and security principles, personal data storage and destruction policies, service quality, terms of use and other practices of the sites.

3.20 The order pre-information form - distance sales contract terms and conditions, which you will see during each transaction, will also apply to your purchases from our website.

4. Termination of the Contract

This agreement will remain in effect until the member cancels their membership or their membership is terminated by Black Fashion. Black Fashion may unilaterally terminate this agreement by canceling the member's membership if the member violates any provision of this membership agreement.

5. Resolution of Disputes

We are pleased to address the legitimate requests, complaints, and all other applications of our members. If this is not possible, within the legal monetary limits, you may apply to the Provincial and District Arbitration Boards and Consumer Courts in your place of residence. The Istanbul Courts and Enforcement Offices have jurisdiction over disputes related to this agreement.

6. Entry into force

This agreement comes into effect upon the member's complete registration process.
